Official Contest Rules

No purchase is necessary to enter or win.
The WKRG Weather Kids Sweepstakes is sponsored by Media General Operations, Inc. d/b/a WKRG-TV and WKRG.com, PepsiCo, Inc. (“Pepsi”), Buffalo Rock Company (“Buffalo Rock”), and the Gulf Coast Exploreum Science Center (“the Exploreum”) (collectively referred to as “Sponsors”) and administered by WKRG.com. The geographic scope of this sweepstakes is Alabama, Mississippi and Florida.
Sweepstakes is subject to all federal, state and local laws. Void where prohibited. By entering, entrants agree to these Official Rules. Limit one (1) entry per child who is from six to twelve (6-12) years old. Limit one (1) prize per household. “Household” includes all persons residing together in a single residence, whether or not related.
Sweepstakes begins on February 20, 2009 at 12:01 a.m. CST, and ends on December 18, 2009 at 11:59 p.m. CST (“Sweepstakes Period”). Deadline for entries into each weekly drawing is 11:59 p.m. CST on the Friday of the week preceding the drawing. Final entry deadline is December 11, 2009 at 11:59 p.m. CST. Drawings to determine Weekly Winners will be held every Friday starting on February 27, 2009 and ending on December 18, 2009, for a total of forty-three (43) weekly drawings.

Eligibility

At the time of entry, all entrants must be twenty-one (21) years old and the parent or legal guardian of a child who is from six to twelve (6-12) years old (“Eligible Child”). Both entrant and Eligible Child must be legal residents of Alabama, Mississippi or Florida at the time of entry.
Employees of Media General Operations, Inc. d/b/a WKRG-TV and WKRG.com, PepsiCo, Inc., Buffalo Rock Company, and the Gulf Coast Exploreum Science Center and the members of their immediate families (defined as spouse, parents, siblings or children) and households are not eligible to enter or win.

Prizes/Odds

Weekly Prizes (43): Each Weekly Prize consists of a “Weather Kids’ Prize Pack,” consisting of a beach ball, “Family Four Pack” of tickets from the Gulf Coast Exploreum, a Pepsi “Prize Pack” and water bottle. Individual prize components may vary at Sponsors’ discretion. Each week’s Eligible Child also will have an opportunity to appear live on WKRG News 5 This Morning during the weather segment with John Nodar. Live appearance has no retail value. Approximate Retail Value (“ARV”) of each Weather Kids’ Prize Pack is $50.00.
The odds of winning a Weekly Prize depend on the number of entries received and accumulated (if applicable) prior to that week’s drawing.

Prize Restrictions

As a condition of participating in the live appearance with John Nodar, Weekly Winners will be required to present their Eligible Children at the WKRG studios, 555 Broadcast Drive, Mobile, AL no later than 6:00 AM on the Friday morning following notification of winning. The opportunity to appear on WKRG is solely at WKRG’s discretion and is subject to other station rules and requirements. In the event that severe weather, network programming or any other event pre-empts the broadcast of a particular live appearance or any other circumstance results in the cancellation or interruption of a particular live appearance, WKRG in its sole discretion will make reasonable efforts, but shall not be required, to reschedule the affected live appearance during the next available Friday morning weather segment. However, in the event that such efforts are not successful, that live appearance will be cancelled and the affected Weekly Winner and Eligible Child will not be entitled to any alternate prize or compensation by WKRG.com.
Exploreum tickets may be subject to additional restrictions as may be imposed by the Exploreum. Anyone who acts in a disruptive way or otherwise violates the rules of the Exploreum will be required to leave the facility and will forfeit the tickets.
All details of all prizes shall be at Sponsors’ sole discretion. Winners assume sole responsibility for all costs associated with the prizes not explicitly outlined above, including without limitation, transportation, hotel accommodations, meals, souvenirs, gratuities, and parking. All federal, state and local taxes (if any) are the sole responsibility of the winners.
Any portion of any prize not used or claimed by any winner is forfeit and no cash substitute will be offered or permitted. Prizes are not redeemable for cash and may not be sold or bartered. Prizes may not be transferred or substituted except that WKRG.com in its discretion may substitute a prize, or portion thereof, with a prize or portion of equal or greater value if it deems necessary. Any such changes will be announced.
All prizes are provided “as is” with no warranty or guarantee either express or implied by Sponsors. Merchandise prizes carry no warranty other than that offered by manufacturers. Sponsors have neither made nor are responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality, mechanical condition or fitness for a particular purpose. Other restrictions apply.

To Enter

Entries will be accepted for the weekly drawings beginning February 20, 2009 at 12:01 a.m. CST. Deadline for each weekly drawing is the Friday preceding that weekly drawing at 11:59 p.m. CST. Final deadline to enter is Friday, December 11, 2009 at 11:59 p.m. CST. Limit one (1) entry per child who is six to twelve (6-12) years old.
There is only one way to enter. Go to www.wkrg.com and locate the contest/sweepstakes page. Complete an Official Entry Form with the following required information: (a) name, (b) address, (c) telephone number, (d) e-mail address, (e) date of birth, (f) name of the Eligible Child, (g) age of the Eligible Child, (h) name of school attended by the Eligible Child, (i) sport or hobby enjoyed by the Eligible Child (other than weather), and (j) a brief statement about why you believe the Eligible Child would be a good candidate for assisting John Nodar with the weather.
To be eligible for a weekly drawing, all entries must be received by WKRG.com no later than 11:59 p.m. CST on the Friday of the week preceding the weekly drawing. WKRG’s computer is the official time-keeping device for this Sweepstakes.
Entrants who fail to provide the required information will not be eligible to win and will not be notified by WKRG.com. All entries become the property of WKRG.com and will not be returned. WKRG.com is not responsible for lost, late or misdirected entries or for entries that for any reason are not received by WKRG.com by the stated deadlines. No entries other than through the website method stated above will be permitted. LIMIT: ONE ENTRY PER ELIGIBLE CHILD AND PER E-MAIL ADDRESS (REGARDLESS OF WHETHER MORE THAN ONE PERSON USES THE SAME E-MAIL ADDRESS). Uses of automated devices are not valid for entry. Entrants will see a web page confirming the entry after submission. Entries must include a valid e-mail address for the entrant.
In the event of a dispute as to the identity or eligibility of a winner based on an e-mail address, the winning entry will be deemed made by the “Authorized Account Holder” of the e-mail address submitted at time of entry. “Authorized Account Holder” is defined as the natural person, 21 years of age or older, who is assigned to an e-mail address by an Internet access provider, online service provider, or other organization (e.g., business, education institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.
The information that you provide in connection with the Sweepstakes may be used by WKRG.com in accordance with its Privacy Policy, which is found at www.wkrg.com and which may be updated from time to time.

Weekly Prize Drawing

From February 27, 2009 until December 18, 2009, Weekly Drawings to determine winners will be held each Friday or within a reasonable time thereafter, at which time WKRG.com or its designee will randomly choose one (1) name from all timely entries received prior to that Weekly Drawing, including all prior non-winning entries that have accumulated to date. Subject to verification of eligibility, the person whose name is so drawn will be declared the Weekly Winner and the Eligible Child designated on his or her entry form will be the Weather Kid of the Week. Non-winning entries will be carried forward to the following weekly drawings until they are selected or until the Sweepstakes ends.

Winner Notification

WKRG.com will contact all potential winners by telephone in accordance with the information supplied to WKRG.com on their Entry Forms. Winners may be verified over the telephone at the time and may be asked to provide WKRG.com with valid identification and execute an affidavit of eligibility and, where legal, a publicity release. Acceptable identification includes a valid driver’s license or other valid picture ID showing name and address. Winners may also be required to furnish a copy of the Eligible Child’s birth certificate to confirm eligibility. Faxes will not be accepted. The winners may also be required to sign other legal documents, including tax forms and a release supplied by WKRG.com that, among other disclaimers, releases Sponsors and a range of subsidiaries, directors, agents, agencies, affiliates, franchisees, promoters, officers, directors, employees and related persons from any and all liability related to this Sweepstakes and the receipt and use of any prize, including the Eligible Child’s appearance on WKRG News 5 This Morning.
In the event that any potential winner (a) cannot be contacted directly by WKRG.com within forty-eight (48) hours from first attempted notification, (b) fails to satisfy any eligibility or verification requirement herein, (c) declines to accept the prize, (d) or is otherwise determined to be ineligible, WKRG.com in its discretion may disqualify that individual and an alternate winner will be chosen by random drawing to be held as soon as reasonably practicable after initial winner is determined to be ineligible. Alternate winners are subject to all eligibility requirements and restrictions of these Official Rules. In the event that WKRG.com is unable to verify an eligible winner and child for any weekly prize after one (1) alternate drawing, no further drawings for that prize will be conducted and that prize will not be awarded.

Publicity Release

The names and/or photographs of the confirmed Weekly Winners and, subject to their permission, of their Eligible Children, may be posted on the WKRG website, at www.wkrg.com.

Limitation of Liability/Disclaimer of Liability

Entrants agree that Media General Operations, Inc. d/b/a WKRG-TV and WKRG.com, PepsiCo, Inc., Buffalo Rock Company, and the Gulf Coast Exploreum Science Center, and a range of subsidiaries, directors, agents, agencies, affiliates, franchisees, promoters, officers, directors, employees and related persons (a) are not responsible for lost, interrupted, or unavailable network, server, or other connections, or for any failed telephone or computer hardware or software, or for any failed, delayed, misdirected, corrupted, or garbled transmissions or errors of any kind, whether human, mechanical, or electronic, or for entries that for any reason are not received by WKRG.com by the deadlines stated above; (b) are not responsible for any injury or damage to any computer, modem or other electrical device as a result of participation in this sweepstakes or downloading of any software or materials; (c) are released from any and all liability related to this Sweepstakes and the receipt and use of the prize, including the live appearance; and (d) will not be responsible for the inability to select winners because of postal failure, equipment failure, or data storage failure or for the inability to conduct the live appearance portion of any weekly prize for any reason whatsoever.

Miscellaneous

All federal, state and local laws apply. WKRG.com shall be entitled to interpret these Official Rules as needed — including but not limited to rules regarding entries, eligibility, selection of winners, deadlines, restrictions on prizes, and the live appearances — and all of its decisions are final. By entering, entrants agree to these Official Rules.
WKRG.com reserves the right to cancel, terminate or suspend this Sweepstakes or any part of this Sweepstakes should any non-authorized intervention, network failure, information storage failure, telecommunications failure, malfunction, or other causes beyond its control, corrupt or impair the security, administration, fairness and/or operation of this Sweepstakes as determined by WKRG.com in its sole discretion, at which time WKRG.com will conduct a random drawing from among all non-suspect entries received at the time of the Sweepstakes cancellation, termination or suspension.
WKRG.com reserves the right to prohibit any entrant from participating in the Sweepstakes if, at its sole discretion, WKRG.com finds such entrant to be tampering with the entry process or the operation of the Sweepstakes, or if such entrant repeatedly shows a disregard for, or attempts to circumvent, these Official Rules, or if the entrant acts: (a) in a manner WKRG.com determines to be not fair or equitable; (b) with an intent to annoy, threaten or harass any other entrant or Sponsors; or (c) in any other disruptive manner. Any person attempting to defraud or tamper with this Sweepstakes in any way will be ineligible for prizes and may be prosecuted to the full extent of the law. Tampering includes attempting to enter more than once by using an automated device or by using more than one e-mail address. Any failure by the WKRG.com to enforce any of these Official Rules shall not constitute a waiver of such Official Rules.
WKRG.com reserves the right to correct typographical or clerical errors in any sweepstakes-related materials. No more than the stated number of prizes will be awarded. In the event that production, technical, seeding, programming or any other reasons cause more than the stated number of prizes as set forth in these Official Rules to be available and/or claimed, WKRG.com reserves the right to award only the stated number of prizes by a random drawing among all legitimate, un-awarded, eligible prize claims.

Disputes

By entering the Sweepstakes, entrants agree that (a) any and all disputes, claims, and causes of action arising out of or connected with the Sweepstakes, or any prizes awarded, shall be resolved individually, without resort to any form of class action; (b) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Sweepstakes, but in no event attorneys' fees; and (c) under no circumstances will any entrant be permitted to obtain any award for, and entrant hereby waives all rights to claim punitive, incidental or consequential damages and any and all rights to have damages multiplied or otherwise increased and any other damages other than actual out-of-pocket expenses.
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrants and Sponsors in connection with the Sweepstakes, shall be governed by, and construed in accordance with the laws of the State of Alabama, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of the laws of any jurisdiction other than the State of Alabama. Any legal proceedings arising out of this Sweepstakes or relating to these Official Rules shall be instituted only in the federal or state courts located in the State of Alabama, County of Mobile, and the parties consent to jurisdiction therein with respect to any legal proceedings or disputes of whatever nature arising under or relating to these rules. The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Official Rules shall otherwise remain in effect and be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.
